TERMS AND CONDITIONS OF SALE – SAPHIR TIME
Article 1 : Objet
These Terms and Conditions govern the sale of second-hand and collectible watches on the Saphir Time website (hereinafter “the Seller”) to any natural person of legal age acting as a consumer (hereinafter “the Buyer”).
Article 2 :Product Features (Vintage Characteristics) : Caractéristiques des Biens (Spécificités Vintage)
The Buyer acknowledges that they are purchasing a second-hand item.
Condition: The watches show signs of wear consistent with their age. The photographs provided form an integral part of the description.
Note: For vintage mechanical watches, a variation in timekeeping (running fast or slow) of a few minutes a day is considered normal for the period and does not constitute a breach of conformity.
Water resistance (Disclaimer): Unless explicitly stated otherwise in the advertisement, the water resistance of watches over 10 years old is no longer guaranteed. Given the age of the seals and components, it is strongly advised not to expose the watch to water or moisture. Any damage resulting from immersion will void the warranty.
Article 3 : Prices and Invoicing (VAT not applicable) : Prix et Facturation (TVA non applicable)
Prices are shown in euros (€) as the net amount payable.
The Seller is exempt from VAT under the VAT exemption scheme. Consequently, VAT is not payable on sales, in accordance with Article 293 B of the General Tax Code (CGI). Payment is due immediately upon placing the order.
Article 4 :Right of Withdrawal : Droit de Rétractation
In accordance with Article L221-18 of the Consumer Code, the Buyer has a period of 14 days from the date of receipt to exercise their right of withdrawal.
L’objet doit être retourné dans son état exact d’envoi, ne pas avoir et porté avec ses étiquettes et autocollants.
Les frais de retour sont à la charge exclusive de l’Acheteur.
Any damage found upon return (impact, the case having been opened, attempted repairs) may result in a deduction from the refund or the refusal of the refund.
Article 5 : Statutory Guarantees : Garanties Légales
As a professional seller, Saphir Time applies:
The Statutory Guarantee of Conformity: For second-hand goods, any defects that become apparent within 12 months of delivery are presumed to have existed at the time of sale.
The Warranty against Hidden Defects.
Note : La garantie ne couvre pas l’usure normale, les bris de verre, ou les dégâts causés par une mauvaise utilisation (chocs, magnétisme ou immersion).
Article 5.1 Every product sold by Saphir Time is a precision instrument. In the event of a malfunction or technical problem, the customer must under no circumstances attempt to open, alter or repair the item themselves or through an unauthorised third party.
Any opening of the casing, internal tampering or attempt at repair by the customer will result in the immediate and automatic cancellation of the manufacturer’s warranty, as well as the right to return the item or receive a refund. To be eligible for a repair, the item must be returned in its original condition, accompanied by all its accessories, and must not have been subject to any external technical intervention.
Article 5.2 : Garantie internationale et modalités de Service Après-Vente (SAV)
The warranty provided by Saphir Time on its timepieces is strictly subject to the condition that any repairs are carried out exclusively at our technical workshop.
5.2.1Exclusive repair service: Under no circumstances may any watch requiring repair, adjustment or inspection under warranty be sent to any address other than the Saphir Time boutique. Any opening of the case, technical modification or attempt at repair carried out by the purchaser or a third party (local watchmaker or unauthorised centre) will result in the immediate and complete cancellation of the warranty.
5.2.2. Ventes hors Union Européenne : Pour toute commande livrée en dehors de l’Union Européenne, les modalités logistiques suivantes s’appliquent :
Postage costs (outbound): The cost of posting the watch to our shop is borne entirely and exclusively by the buyer. The product is the customer’s responsibility until it has been received by our staff.
Return postage charges: Once the work has been completed (repair or replacement), the cost of returning the watch to the buyer’s country is payable by the buyer. The watch will only be returned once the buyer has paid the international postage charges in full.
Customs Duties and Taxes: The buyer is solely responsible for all customs duties, import taxes or administrative fees relating to the dispatch and return of the parcel between their country and France.
Article 6 : Préparation de commande et Preuve d’état
To ensure that the item complies with the terms of the sale and to protect both parties, Saphir Time systematically takes detailed photographs and videos of each watch, as well as of the packaging process, immediately prior to dispatch.
These digital documents provide irrefutable proof of the watch’s condition and proper functioning at the time it was handed over to the carrier. They may be produced in the event of a dispute or a claim for damage caused during transport.
Article 7 : Livraison
